§ 12-30. Cable television.

  • New Hope is a member of the Northwest Suburbs Cable Commission under a joint powers agreement pursuant to M.S. 238.08 and 471.59, and is a party to a cable television franchise under this agreement which is found in its entirety as Appendix F of this Code.

    (1)

    Cable commissions member. The member communities of the Northwest Suburbs Cable Commission are: Brooklyn Center, Brooklyn Park, Crystal, Golden Valley, Medicine Lake, Maple Grove, New Hope, Osseo, Plymouth and Robbinsdale.

    Cable commission ordinance adopted. New Hope adopted, by reference, the Northwest Suburbs Cable Communication Ordinance, which took effect November 13, 1981, by Ordinance 82-3, and this ordinance is continued in effect unchanged, except for wording as to the effective date, and except that it is renumbered to paragraphs (1) through (5) of this subsection, 12.302, as follows:

    a.

    Short title. The short title of this ordinance shall be "New Hope Cable TV Adopting Ordinance".

    b.

    Adoption of cable communications ordinance. The Northwest Suburbs Joint Cable Communications Ordinance, which took effect November 13, 1981, and for which the Minnesota Cable Communications Board issued its certificate of confirmation pursuant to M.S. Section 238.09 effective September 14, 1981, is adopted as a franchise regulating a cable communications systems with Northern Cablevision Northwest, Inc. within this city and is hereby incorporated in and made a part of the ordinances of this city as completely as if set out here in full, as Appendix F of the City Code.

    c.

    Administration and enforcement. The administration and enforcement of the cable communications system authorized pursuant to the ordinance incorporated by reference in (2), above, shall be at the direction of the city manager and he shall periodically review the progress and benefits of the membership of this city in the Northwest Suburbs Cable Commission and review of the cable communications system to the city thereby.

    d.

    Violations. Any violation of the ordinance adopted by reference is declared to be a violation of the Code of this City when such violation occurs in this city, and shall constitute a misdemeanor. Upon conviction, the penalty shall be that applicable to such violations as prescribed by the Code of this city.

    e.

    Effective date. This adopting ordinance was originally passed on March 8, 1982, and became effective upon its publication in the official newspaper of the city on April 1, 1982.
