§ 13-2. Rules and definitions.

  • (a)

    Rules. For the purpose of this chapter, words used in the present tense shall include the future; words in the singular shall include the plural, and the plural the singular; and the word shall is mandatory and not discretionary.

    (b)

    Definitions. For the purpose of this chapter, certain words and terms are hereby defined as follows:

    Alley is a public right-of-way which affords a secondary means of access to abutting property.

    Block is an area of land within a subdivision that is entirely bounded by streets, or by streets and the exterior boundary or boundaries of the subdivision, or a combination of the above with a river or lake.

    Boulevard is the portion of the street right-of-way between the curb line and the property line.

    City is the City of New Hope.

    City council is the governing body of the City of New Hope.

    Comprehensive plan refers to the group of maps, charts and texts that make up the comprehensive long-range plan of the city.

    Design standards are the specifications to land owners or subdividers for the preparation of plats, both preliminary and final, indicating among other things, the optimum, minimum or maximum dimensions of such items as rights-of-way, blocks, easements and lots.

    Easement is a grant by a property owner for the use of a portion of land for the purpose of constructing and maintaining drives, utilities, including, but not limited to, sanitary sewers, water mains, electric lines, telephone lines, storm sewer or storm drainage ways and gas lines.

    Final plat is a drawing or map of a subdivision, meeting all of the requirements of the city and in such form as required by Hennepin County for the purpose of recording.

    Land, buildable. Buildable land shall mean land situated within the boundary lines of any lot or parcel of a subdivision that is not considered a wetland or water body, or is not within a 100-year flood fringe, floodway, utility, transmission or right-of-way easement.

    Lot is a portion of a subdivision or other parcel of land intended for building development or for transfer of ownership.

    Outlot is a lot remnant or parcel of land left over after platting, which is intended as open space or other future use for which no building permit may be issued.

    Owner includes the plural as well as the singular, and where appropriate shall include a natural person, partnership, firm association, public or quasi-public corporation, private corporation, or a combination of them.

    Parks and playgrounds are public land and open spaces in the City of New Hope dedicated or reserved for recreation purposes.

    Percentage of grade, on street center line, means the distance vertically (up or down) from the horizontal in feet and tenths of a foot for each one hundred feet of horizontal distance.

    Pedestrian way is a public right-of-way or private easement across a block to provide access for pedestrians and which may be used for the installation of utility lines.

    Planning commission is the Planning Commission of the City of New Hope.

    Preliminary plat is a tentative drawing or map of a proposed subdivision meeting requirements herein enumerated.

    Protective covenants are contracts entered into between private parties and constitute a restriction of the use of all private property within a subdivision generally intended for the benefit of the property owners and for providing mutual protection against undesirable aspects of development which would tend to impair stability of values.

    Setback line is a line within a lot designated on the preliminary plat between which, and the adjacent street, the erection of an enclosed structure or portion thereof is prohibited.

    Street is a public right-of-way affording primary access by pedestrians and vehicles to abutting properties, whether designated as a street, highway, thoroughfare, parkway, road, avenue, or boulevard.

    Streets—Principal arterial. Principal arterial streets are those highways used for high volumes of traffic, and serving as the major links between the major subareas of the region.

    Streets—Minor arterial. Minor arterial streets are those used primarily for heavy traffic, and serving as thoroughfares between the major subdistricts of the community.

    Streets—Collector. Collector streets are those that carry traffic from minor streets to the major system of arterials, including the principal entrance streets of residential districts.

    Street—Minor. Minor streets are those which are used primarily for access to abutting properties.

    Street—Marginal access (service road). Marginal access (service road) streets are minor streets which are parallel and adjacent to thoroughfares and highways, and which provide access to abutting properties and protection from through traffic.

    Street—Cul-de-sac. Cul-de-sac street is a minor street with only one outlet and having an appropriate terminal for the safe and convenient reversal of traffic movement.

    Street width is the shortest distance between lines of lots delineating the streets right-of-way.

    Subdivider is a developer, and is any individual, firm, association, syndicate, co-partnership, corporation, trust or other legal entity having sufficient proprietary interest in the land sought to be subdivided to commence and maintain proceedings to subdivide the same under this chapter.

    Subdivision is a described tract of land which is to be or has been divided into two or more lots or parcels, for the purpose of transfer of ownership or building development, or, if a new street is involved, any division of a parcel of land. The term includes resubdivision and, where it is appropriate to the context, relates either to the process of subdividing or to the land subdivided.

    Subdivision bond is security approved by the city to assure the city that improvements and utilities will be actually constructed and installed in accordance with city specifications and requirements, as expressed in a contract and by this Code and city regulations. Such security may be by cash deposit, savings account or certificate of deposit assigned to the city, by letter of credit, corporate surety bond or other bond with surety and conditions satisfactory to the city.
